By accessing or using the Platform, you confirm that you:

If you are using the Platform on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms. "You" in these Terms refers to both you individually and that entity.

To access most features of the Platform, you must create an account. You agree to:

5. Acceptable use

You agree to use the Platform only for lawful purposes and in compliance with these Terms. You must not use the Platform to:

Prohibited destinations: You may not use Attributr links or QR codes to redirect to sites that promote illegal activity, hate speech, adult content without age verification, or any content that violates our Content Policy. Violation of this clause may result in immediate account termination.

We reserve the right to investigate suspected violations and, where necessary, remove links, suspend accounts, or report conduct to relevant authorities.

6. Your content

Ownership: You retain all ownership rights in the Content you submit to the Platform, including destination URLs, campaign names, and any custom branding.

Licence to us: By submitting Content to the Platform, you grant Attributr a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that Content solely for the purpose of providing the Platform services to you.

Your responsibility: You are solely responsible for ensuring that your Content and the destinations your links point to comply with all applicable laws and do not infringe third-party rights. We do not proactively review all Content or destinations but reserve the right to remove or disable links that we determine, in our sole discretion, violate these Terms.

7. Data and attribution tracking

7.1 Attribution Data ownership

Attribution Data generated by clicks and scans of your links is associated with your account and is accessible to you via the Platform. You own your Attribution Data, subject to the rights we require to provide the service.

7.2 Anonymisation

Attributr anonymises End User data as described in our Privacy Policy. You must not configure the Platform in a way that causes it to collect personally identifiable information about End Users without appropriate consent mechanisms in place on your own platforms.

7.3 Your tracking obligations

If you install our tracking snippet on your website or use our API to pass conversion data, you are responsible for:

You may export your Attribution Data at any time from the Platform dashboard. On plan cancellation, you have 30 days to export your data before it is deleted in accordance with our retention policy.

8. Payment and billing

8.1 Subscriptions

Paid Subscriptions (Pro and Business) are billed in advance on a monthly or annual basis as selected at signup. All fees are quoted in Australian Dollars (AUD) unless otherwise stated.

8.2 Payment processing

Payments are processed by Stripe. By providing payment details, you authorise us to charge your nominated payment method on each billing cycle. We do not store your card details.

8.3 Failed payments

If a payment fails, we will attempt to collect payment again within 3 business days. If payment cannot be collected after 7 days, your account may be downgraded to the Free plan and access to paid features may be suspended until payment is resolved.

8.4 Refunds

We offer a 14-day money-back guarantee on new Pro or Business subscriptions. After 14 days, subscription fees are non-refundable except where required by Australian Consumer Law. Annual plan fees are non-refundable after the 14-day period; you will retain access until the end of the billing year.

8.5 Price changes

We may change Subscription prices from time to time. We will provide at least 30 days' notice of any price increase. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

8.6 Taxes

Prices shown are exclusive of GST. GST (10%) will be added where applicable for Australian customers. You are responsible for any other taxes applicable in your jurisdiction.

9. Intellectual property

Attributr's IP: The Platform, including its software, design, trademarks, and branding (including the Attributr name and logo), is owned by or licensed to Attributr Pty Ltd. Nothing in these Terms transfers any ownership of our IP to you.

Feedback: If you provide us with feedback, suggestions, or ideas about the Platform, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation or attribution.

10. Confidentiality

Each party may have access to confidential information of the other in connection with these Terms. Each party agrees to keep such information confidential and not to disclose it to third parties without prior written consent, using at least the same degree of care it uses for its own confidential information. This obligation does not apply to information that is or becomes publicly known through no fault of the receiving party.

11. Third-party integrations

The Platform may integrate with third-party services (Shopify, HubSpot, Salesforce, etc.). Your use of those integrations is subject to the terms of service of the respective third party. Attributr is not responsible for the availability, accuracy, or conduct of any third-party service. We may discontinue any integration at any time.

12. Service availability and SLA

We target 99.9% uptime for the link redirect infrastructure (the component that resolves your short links and QR codes). The Attributr dashboard and analytics interface are provided on a best-efforts basis.

Planned maintenance will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors outside our reasonable control, including third-party infrastructure failures, DDoS attacks, or force majeure events.

13. Termination and suspension

13.1 By you

You may cancel your account at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

13.2 By us

We may suspend or terminate your account, with or without notice, if:

On termination: your links will cease to resolve, your Attribution Data will be retained for 30 days (during which you may export it), and thereafter deleted in accordance with our Privacy Policy. Provisions that by their nature should survive termination (including payment obligations, IP ownership, limitation of liability) will survive.

14. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Australian Consumer Law.

15. Warranties and disclaimers

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: the Platform will be uninterrupted or error-free; Attribution Data will be accurate, complete, or suitable for any particular business decision; or that the Platform will meet your specific requirements.

Nothing in this section affects any rights you may have under the Australian Consumer Law that cannot be excluded.

16. Indemnification

You agree to indemnify, defend, and hold harmless Attributr Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

17. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You submit to the exclusive jurisdiction of the courts of New South Wales.

Dispute resolution: Before commencing any legal proceedings, you agree to contact us at legal@attributr.co and give us 30 days to attempt to resolve the dispute in good faith. This does not prevent either party from seeking urgent injunctive relief.

If you are a consumer located in the EU or UK, you may also have the right to access alternative dispute resolution mechanisms or your local courts.

18. Changes to these terms

We may update these Terms at any time. For material changes, we will provide at least 30 days' notice by email or in-app notification before the new terms take effect. Your continued use of the Platform after the effective date constitutes acceptance. If you do not accept the updated Terms, you must cease using the Platform and cancel your account.
